Who Organizes Mediation?

Mediation is typically organized by the mediator conducting the mediation. The parties or their lawyers will normally approach the mediator with a list of dates to schedule the mediation. If the parties to a dispute are required to attend by a court or employer, then the body requiring the mediation will contact a mediator. In Ontario, under the mandatory mediation process the courts give the parties an opportunity to select and book their own mediator; however if the parties fail to agree on a mediator the court appoints a mediator. No matter who organizes the mediation the parties retain control over the process.
